About the Event
The presentation will examine generally the types of claims between participants of a construction project, and specifically Warranty, Professional Design, and Payment claims. These claims will be compared and contrasted in traditional design-bid-build delivery as well as design-build construction delivery methods. Additionally, the presentation will define, examine and discuss express and implied warranty liability issues, the design professionals role and liability related to the project, and the remedies, processing and timing of payment claims.
Learning Objectives:
- The role, significance and legal importance of understanding the delivery method and differences between Design-Bid-Build and Design-Build procurement;
- Define, examine and discuss express and implied warranty liability issues and each construction participants role and exposure to liability of these claims;
- The role of the design professionals to the project, the practical effects of the difference in procurement delivery method and the standard of care as it relates to a project;
- Payment claims, including timing, type and remedies to address a failure of payment between construction participants.
